1. General
This website, www.fintkmobility.com, including all sub-domains, mobile applications and digital platforms operated in connection therewith (collectively, the “Platform”), is owned and operated by Finreliable Mobility Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at Unit No. 402, Tower B4, 4th Floor, Spaze iTech Park, Sector 49, Sohna Road, Gurgaon, Haryana – 122018 (“FRMPL”, the “Company”, “we”, “us” or “our”). All information, content, tools and material made available on the Platform are provided for general information and facilitation purposes only. By accessing or using the Platform, you acknowledge that you have read, understood and agreed to this Disclaimer, which shall be read together with, and form an integral part of, the Terms and Conditions, Privacy Policy and Refund Policy published on the Platform. If you do not agree with any part of this Disclaimer, please discontinue use of the Platform immediately.
2. Corporate Status and Group Affiliation
FRMPL is a member of the Ikeda Limited group of companies. Notwithstanding such affiliation, FRMPL is a distinct and separate legal entity, and the services offered through the Platform are offered by FRMPL alone in its own name and on its own account. Nothing on the Platform constitutes an offer, commitment, representation, warranty or guarantee by, or creates any obligation or liability on the part of, Ikeda Limited or any other group company, affiliate, director, officer or employee thereof. No guarantee, surety or assurance of any nature has been extended by Ikeda Limited or any group entity in respect of the obligations of FRMPL, unless expressly recorded in a written instrument executed by the entity concerned.
3. Nature of Services – Facilitation Only
FRMPL is a technology-enabled distribution and facilitation platform. The services made available on or through the Platform – including banking and payment services, bill payments, travel services, insurance distribution, investment facilitation and credit facilitation – are rendered by FRMPL in the capacity of an agent, business correspondent, facilitator, distributor or referral entity of and for third-party banks, financial institutions, payment system participants, insurers, intermediaries, travel suppliers and other duly authorised entities (collectively, “Service Providers”). FRMPL is not a bank, non-banking financial company, payment system operator, deposit-taking entity, insurer or asset management company, and does not itself provide, underwrite or guarantee any banking, lending, insurance or investment product. The contract for the underlying product or service is concluded directly between the customer and the relevant Service Provider, and is governed by that Service Provider’s terms, eligibility criteria and applicable regulatory framework.
4. Banking and Payment Services
Services such as the Aadhaar Enabled Payment System (AePS), Aadhaar Pay, Micro ATM (mATM), Domestic Money Transfer (DMT) and Cash Management Services (CMS) are facilitated by FRMPL and its authorised merchant network as a business correspondent / agent of partner banks, in accordance with the framework prescribed by the Reserve Bank of India (“RBI”) and the operating guidelines of the National Payments Corporation of India (“NPCI”) and other payment system operators, as applicable. All such transactions are processed on the systems of the partner banks and payment networks and remain subject to their respective rules, transaction limits, cut-off timings, system availability and applicable charges. FRMPL does not accept or hold deposits; customer funds at all times remain with the account-holding bank concerned. In the event of a failed, declined or pending transaction, reversal and resolution shall be governed by the applicable RBI directions on turn-around time and the processes of the bank and payment network concerned, and may accordingly take the time prescribed thereunder.
5. Bill Payments and Recharges
Utility bill payments, recharges, FASTag, municipal tax, education fee payments, credit card bill payments and similar collection services are facilitated through the Bharat Bill Payment System / Bharat Connect and other authorised channels, in conjunction with the relevant Service Providers. Bill amounts, due dates and account particulars are sourced from the respective billers, and FRMPL assumes no responsibility for the accuracy of biller data, the timing of credit by the biller or card issuer, or any late payment charges, interest or consequences arising from delays or errors attributable to the biller, the card issuer, the payment network or incorrect details furnished by the user. Users are advised to initiate payments sufficiently in advance of due dates.
6. Travel Services
In respect of flight bookings, bus tickets, hotel bookings, holiday packages and allied travel services, FRMPL acts solely as a booking facilitator and agent. The underlying travel services are provided by the respective airlines, bus operators, hotels, tour operators and other travel suppliers, and every booking is subject to the fare rules, terms of carriage, check-in requirements, cancellation, rescheduling and refund policies of the supplier concerned, which prevail over any general information displayed on the Platform. Fares, tariffs, schedules and availability are dynamic and subject to change until a booking is confirmed and paid for. FRMPL shall not be responsible or liable for any deficiency in service, delay, rescheduling, cancellation, denied boarding, overbooking, downgrade, loss of or damage to baggage or property, personal injury, or any other act or omission attributable to a travel supplier or to events beyond FRMPL’s reasonable control, including force majeure. Travellers are solely responsible for ensuring that they hold valid identification, travel documents, visas and health clearances, and for complying with the requirements of the relevant authorities and suppliers. Refunds, where due, shall be processed in accordance with the supplier’s policy and the Refund Policy published on the Platform, and shall be subject to the time taken by the supplier and payment channels to remit the amounts.
7. Insurance Services
Insurance is the subject matter of solicitation. Insurance products displayed or referenced on the Platform are products of insurers registered with the Insurance Regulatory and Development Authority of India (IRDAI) and are distributed or facilitated through duly registered insurance intermediaries with whom FRMPL has entered into arrangements. The decision to accept a risk, issue a policy, and admit or reject a claim vests solely with the insurer concerned, in accordance with the policy terms and applicable law. FRMPL does not underwrite risk, does not guarantee the issuance of any policy or the outcome of any claim, and makes no representation as to the suitability of any product for any person. Prospective policyholders are advised to read the sales brochure, prospectus and policy wordings carefully, and to assess their requirements independently, before concluding a sale.
8. Investment Services
Mutual fund investments are subject to market risks; read all scheme related documents carefully. Investment products, including mutual funds and non-convertible debentures, referenced on the Platform are offered, distributed or executed through intermediaries duly registered with the Securities and Exchange Board of India (SEBI) and/or the Association of Mutual Funds in India (AMFI), as applicable. FRMPL operates on a distribution / execution-facilitation basis only and does not provide investment advice, portfolio management or research services. Past performance is not indicative of future returns, and no assurance or guarantee of returns, capital protection or performance is given by FRMPL or any Service Provider. Investors should consider their investment objectives and risk appetite, and consult their own financial advisers, before investing.
9. Credit and Peer-to-Peer Lending
Any loan, credit facility or financing product referenced on the Platform is provided by banks or non-banking financial companies regulated by the RBI, and any peer-to-peer lending facility is operated by entities holding a certificate of registration as an NBFC-P2P from the RBI. FRMPL is not a lender, does not extend credit in its own name, and does not guarantee the sanction of any facility, the terms thereof, or the repayment or recovery of any amount. Credit decisions, pricing, disbursal and recovery are matters exclusively between the borrower/lender and the regulated entity concerned, subject to its policies and applicable law. Participation in peer-to-peer lending involves risk of loss of principal, and prospective participants should review the risk disclosures of the platform concerned carefully.
10. No Professional Advice
The content on the Platform, including blogs, articles, FAQs, calculators and illustrations, is of a general nature and is not intended to constitute, and shall not be construed as, financial, investment, insurance, legal, tax or other professional advice, or as a solicitation, recommendation or endorsement of any particular product, provider or course of action. Users should obtain appropriate independent professional advice before acting on any information contained on the Platform.
11. Accuracy of Information; Availability of the Platform
While FRMPL endeavours to ensure that the information on the Platform is accurate and current, the Platform and all content thereon are provided on an “as is” and “as available” basis, without warranty of any kind, whether express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose or non-infringement. Information, products, features, charges and commission structures may be modified, suspended or withdrawn at any time without prior notice. FRMPL does not warrant that the Platform will be uninterrupted, timely, secure or error-free, and shall not be liable for any unavailability or degradation of service arising from maintenance, system failures, network outages, or failures of banks, payment networks or other Service Providers.
12. Third-Party Content and Links
The Platform may contain content, logos, trademarks, advertisements or links pertaining to third parties, including Service Providers. Such material is provided for identification and convenience only and does not amount to an endorsement, affiliation, sponsorship or recommendation by FRMPL, nor by the third party of FRMPL, unless expressly stated. FRMPL has no control over, and accepts no responsibility for, the content, accuracy, security or privacy practices of any third-party website or application, and access thereto is at the user’s own risk and subject to the terms of the third party concerned.
13. Merchant / Retail Partner Network
FRMPL’s services are delivered, in part, through a network of independent merchants, retailers and distributors (referred to on the Platform as “Saathis” or merchant partners). Such merchants are independent business owners and are neither employees nor general agents of FRMPL; their authority is limited strictly to the facilitation of the specific services for which they have been onboarded, on the terms of their respective agreements. No merchant is authorised to collect amounts otherwise than through the designated systems, to issue assurances or guarantees, or to make any representation on behalf of FRMPL beyond the official material published by FRMPL. Customers are advised to transact only with authorised outlets, to insist upon a system-generated receipt or confirmation for every transaction, and to report any irregularity to FRMPL’s customer support.
14. Security and Fraud Caution
FRMPL and its authorised personnel will never ask you to share your OTP, PIN, passwords, CVV, full card details or biometric information over telephone, SMS, e-mail, WhatsApp or social media. Do not share such credentials with any person, including persons claiming to act for FRMPL or its partner banks. Aadhaar-based transactions require the customer’s consent and biometric authentication, and customers should authenticate only for transactions they have themselves initiated. Beware of fraudulent websites, applications, social media handles and communications impersonating FRMPL or the Finkeda brand; the only official website of FRMPL is www.fintkmobility.com and the only official support channels are those published thereon. Any suspected fraud, phishing or unauthorised transaction should be reported immediately to FRMPL’s support channels, the bank concerned and, where appropriate, the National Cyber Crime Reporting Portal (www.cybercrime.gov.in / helpline 1930). FRMPL shall not be liable for losses arising from the user’s sharing of credentials or from transactions authenticated with the user’s credentials or biometrics.
15. Intellectual Property
All intellectual property in the Platform, including the “FinReliable Mobility” name and logo, text, graphics, layouts, software and compilations, is owned by or licensed to FRMPL or its group companies, and no licence or right therein is granted to any user except the limited right to access the Platform for its intended purpose. Trademarks, logos and brand names of third parties, including Service Providers, appearing on the Platform belong to their respective owners and are used solely for identification.
16. Limitation of Liability
To the maximum extent permitted by applicable law, FRMPL, its group companies, directors, officers, employees and agents shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of profits, revenue, business, goodwill, data or opportunity, arising out of or in connection with the use of, or inability to use, the Platform or any service facilitated through it, even if advised of the possibility of such damages. FRMPL’s aggregate liability, if any, in respect of any transaction shall be limited in the manner set out in the Terms and Conditions. Nothing in this Disclaimer excludes or limits any liability that cannot be excluded or limited under applicable law, or affects the statutory rights available to a user under applicable consumer protection or payment system regulations.
17. Amendments
FRMPL reserves the right to amend, modify or replace this Disclaimer at any time without prior notice, by publishing the updated version on the Platform. Continued use of the Platform after such publication shall constitute acceptance of the Disclaimer as amended. Users are advised to review this page periodically.
18. Governing Law and Jurisdiction
This Disclaimer, and any dispute or claim arising out of or in connection with the Platform, shall be governed by and construed in accordance with the laws of India, and shall be subject to the exclusive jurisdiction of the competent courts at Gurugram, Haryana, without prejudice to any mandatory forum prescribed by applicable law.
